The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 Selling Regulations

Whether your order is made via our website, by email or telephone as a Consumer Customer you are covered under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 Selling Regulations laid out by the Office of Fair Trading. In accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 Selling Regulations, the following applies to all transactions undertaken on the Owls Hall Environmental Limited website.

  1. You may cancel your order by giving us notice of cancellation within 14 working days of the date of delivery. Such notice may be given by posting or emailing to the email address or postal address on your Owls Hall Environmental Limited invoice.
  2. We accept returns of items where you have opened the outer packaging to inspect the goods. However, goods returned must not be marked or used in any way. If an item is returned to us and has clearly been used, it will be disposed of and no refund will be issued (this is not in the case where goods are reported faulty within their warranty period). Goods should be returned in the original packaging wherever possible, with any packaging and accessories – please also include a copy of the invoice to aid the refund process.
  3. If you are cancelling your order because of a problem or defect with the goods, please notify us at the time of cancellation.
  4. Upon cancellation, you must arrange return of the goods to us at your cost, which we will organise for you. The exception to this is if the goods are faulty, in which case we will organise collection for items by courier, or by post depending on the items, and we will reimburse reasonable postage costs.
  5. If you receive an incorrect order, such as an item different to the one you ordered, please notify us within 2 working days of receiving your goods. We will ask you to return the incorrect item and will organise dispatch of the correct item, with no additional postage charge.

Exclusion

With MDPE pipe and fittings please ensure that the correct quantity is ordered, as once dispatched and received on site, the manufacturers will not take this back into stock. This is due to them not being able to guarantee the integrity of the pipe/fittings for re sale. As a consequence, Owls Hall Environmental Limited will not accept the return of any MDPE pipe and / or fittings.

If your order is damaged or faulty

If you take receipt of your order from Owls Hall Environmental Limited and find the products to be damaged or faulty, please inform us immediately. You will be required to photograph the damage and email these photographs to us. In the case of a faulty electrical item, then Owls Hall Environmental Limited will request that the faulty item be returned for examination. The carriage cost will be borne by the customer and paid prior to the replacement. The cost of removal of the item and re fitting of the replacement will be borne by the customer.

Owls Hall Environmental Limited does not cover damage during fitting, accidental or malicious damage, improper use or negligence, general wear and tear, damage due to poor installation or servicing, or consequential loss. (All three of which terms include without limitation, loss of profits, loss of business, depletion of goodwill and like loss)

If you want to exchange a product

If you wish to exchange your goods for another size/type of product, please advise us immediately and we will confirm any cost difference. Where an incorrect size/type of product has been ordered by yourself, we will inspect the product when returned to us by yourself, and if it is in a re-sellable condition we will then dispatch the replacement item (following receipt of payment by yourself for any price difference, if applicable).

Exceptions may occur for the supply of treatment systems, septic tanks, pump stations, separators and rain water harvesters, where these goods are sent directly from the manufacturer. This is in light of manufacturers operating their own returns policies.

Summary

You have the right to cancel your order within 14 days of your contract with us or within 14 days of receipt of the goods, whichever is the longer term. If you do find it necessary to cancel your order, you will have your payment refunded (minus delivery cost), and you must organise return of the goods to us or the manufactures address as provided by us. If you cancel the Contract before you have received the goods, but the Company has already processed the goods for delivery, you must not unpack the goods when they are received by you and you must send the goods back to the Company at your own cost and risk. H. Where a contract is cancelled, the customer is obliged under the above regulations to ensure that reasonable care is taken of any goods received and ‘restore’ them to us. This does not mean that the customer is obliged to return them to us unless stipulated in the contract, only that the goods are made available for us to collect.

I. In the case of a cancelled order, should any damage be made to the items between the time of delivery and the time they are returned to us or the manufacturer, or any parts be missing as detailed in the original signed delivery note, then Owls Hall Environmental Limited reserve the right to refuse the return of goods or levy a charge to a maximum of 100% of the cost of the items.

E. If the Contract is cancelled by the Company, the Company will notify you by e-mail at the address given by you in your order form. Any sum debited by the Company from your credit card or debit card will be re-credited to your account within thirty (30) days of the date you place your order. I. Where a delivery charge is not included in the cost of the item then this charge will always be listed as a separate item in the quotation or estimate for the supply of the goods.

L. Customers will be informed of the delivery date of items and must ensure that appropriate arrangements are available to offload, accept, check and sign for goods on site. Should persons not be available to accept goods, items will not be left without a signature. In this instance, the items will be returned to the appropriate depot and delivered on the next available date. A charge may be made for this in line with the manufacturers restocking and or collection charge policy.

M. Any shortages in an order should be notified to Owls Hall Environmental Limited within 24 hours of delivery.

N. On occasions pipework will be delivered on articulated transport vehicles with a length of over 13 metres. All sewage treatment systems, septic tanks, pump stations, separators and rain water harvesters are mostly dispatched directly from the manufacturer and there may be a lead time, which we will advise of.
Should an order for pipework be received, there will be a minimum order value of £600.00 + VAT after discount to qualify for free delivery. Should the order value be less than £600.00, then a delivery charge of up to £85.00 + VAT will be levied. Please ask for further details.
